Picvana Terms of Service

1. The Service

Picvana uses generative AI to restore, colorize, enhance and edit photos you provide, following the mode you choose and any instruction you type. Each request is processed by a third-party AI model. Features, modes and limits may change over time.

You must be old enough to agree to these Terms where you live; minors may use the Service only with a parent or guardian's consent.

2. Free allowance and Pro subscriptions

New installs include a small free allowance. Picvana Pro is offered as weekly, monthly or yearly auto-renewing subscriptions; the price and period are shown in the App before you buy. Each image generated uses one credit. Pro plans include the allowance shown in the App for each period plus a daily fair-use limit, which protects the service for everyone.

Payment and renewal. Payment is charged to your Apple ID or Google Play account when you confirm the purchase. The subscription renews automatically at the same price and period unless it is cancelled at least 24 hours before the end of the current period; your account is charged for the renewal within the 24 hours before the period ends. You can manage or cancel the subscription at any time in your App Store or Google Play account settings; cancelling stops future renewals, and Pro stays active until the end of the period already paid.

Refunds are handled by Apple or Google under their policies. Credits for an edit that fails or returns fewer images than requested are given back automatically. Unused allowance does not carry over to the next period and has no cash value.

3. Your content

You keep all rights to the photos you upload and the results you create. You give us a limited, worldwide, non-exclusive license to process your photo and instruction only to provide the result to you (including sending it to our AI provider). We do not store your photos on our servers and do not use them to train AI models.

You confirm that you have the right to use every photo you upload, and the consent of the people who appear in it where the law requires it.

4. Acceptable use

You may not use the Service to create, upload or share content that: is sexual or nude, or sexualizes anyone, especially minors (which is strictly forbidden and will be reported to the authorities where required); depicts or promotes violence, self-harm, hate or harassment; edits a real person in a misleading, defamatory or harmful way, or impersonates someone (including deceptive "deepfakes"); forges or alters identity documents, certificates or other official records; infringes others' intellectual property, privacy or portrait rights; or is otherwise illegal.

You may not reverse engineer, overload, scrape or bypass the limits or security of the Service. We may refuse requests, filter results and suspend access for violations. Our AI provider applies its own content moderation, and some results may be withheld; credits for withheld images are returned.

5. AI-generated content

Results are generated by AI and may be inaccurate, unexpected or imperfect: restored or colorized photos are artistic reconstructions, not a record of what was really there, and faces or details may change. Results are labeled as AI-generated in the App. Review a result before saving or sharing it, do not present it as an unedited photo where that could mislead others, and do not rely on it for identification, legal, medical or historical purposes.

If a result is offensive or harmful, use the Report button on the result. We review reports and improve our safeguards.

6. Intellectual property

The App, its design, templates, brand names Picvana and 焕片 and the related software belong to CyoFun or its licensors. We grant you a personal, non-transferable, revocable license to use the App for its intended purpose.

7. Disclaimers and limitation of liability

The Service is provided "as is" and "as available". To the extent permitted by law, we do not guarantee that it will be uninterrupted, error-free or that results will meet your expectations, and we are not liable for indirect, incidental or consequential damages, or for loss of data or content. Our total liability for any claim relating to the Service is limited to the amount you paid us for the Service in the 12 months before the claim. Nothing in these Terms limits rights you have under mandatory consumer law.

8. Termination and changes

You may stop using the Service at any time. We may suspend or end access if you break these Terms or if required by law. We may change these Terms; we will update the effective date and, for significant changes, notify you in the App. Continued use after a change means you accept it.

9. Governing law and disputes

These Terms are governed by the laws of the People's Republic of China (excluding Hong Kong, Macao and Taiwan), without regard to conflict-of-law rules, except where the mandatory law of your place of residence gives you more protection. We will first try to resolve any dispute by friendly negotiation; failing that, the dispute shall be submitted to the people's court with jurisdiction in Luoyang, Henan Province, China.

10. App Store terms

If you downloaded the App from Apple's App Store: these Terms are between you and CyoFun only, not Apple; Apple has no obligation to provide maintenance or support and, to the maximum extent permitted by law, no other warranty obligation regarding the App; CyoFun, not Apple, is responsible for any claims relating to the App, including product liability, legal compliance and intellectual property claims; you must comply with applicable third-party terms; and Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them. Apple's Standard EULA applies to the extent these Terms do not cover a matter.
